1) Description Of Service

top40ringtones.co.uk supplies downloadable mobile entertainment content (ringtones and graphics) via the internet, SMS, MMS, WAP and other means of content delivery to specific models of mobile phones advertised as compatible with each particular type of content and network carriers advertised as compatible with our services. Items are sold individually on a one-off basis and the customer is not contracted or committed in any way to any further costs or subscriptions resulting from an order.

Items are sold to the customer on the understanding that these are for personal use only, on the mobile device and telephone number specified by the ordering of the item and that the item will not be transmitted, broadcast, uploaded to any mobile device or computer or used commercially. On this understanding, the Company cannot be held responsible for any breach of these requirements after the item has been sold. Users of the service must not attempt to re-engineer, decrypt, circumvent, break or otherwise alter the service, nor authorise, encourage or support others' attempts to do so, including, but not limited to, any downloads.

2) Access To The Service

The customer can gain access to the service by means of texting to a certain short code number, entering the relevant information requested in the promotional material or telephone a certain premium rate number keying in the information requested during the service. It is the responsibility of the customer to ensure that their network is a carrier of our services, that their phone is of a compatible type to receive the chosen item and that the WAP settings are correct for receiving items which require a connection via the Internet. Helpdesk facilities are available by e-mail or a non-premium rate telephone number. Full compatibility listings are provided on our web sites and on a non-premium rate telephone number.

3) Charges

The charges stipulated in all forms of media marketing are correct at the time of submission of promotional material. Charges and are determined by the rates specifically advertised in the particular advertisement or web site which is the source of the order. These charges do not include any costs incurred for web site connections charged by the customers' networks. In the event of any failure to supply an item advertised as available and for a model of phone and network we advertise as compatible, we guarantee a full refund to the customer of the amount paid to top40ringtones.co.uk for the cost of the order. We cannot be held responsible for any download failures, which are the result of network outages, or circumstances, which are outside the control of our services, for orders placed for mobile phones, which are not advertised as compatible, or for any additional losses other than those charged by top40ringtones.co.uk.

4) Privacy

Mobile phone numbers submitted to top40ringtones.co.uk for orders of mobile content items or contact telephone numbers are not passed on to any other organisation as listings or otherwise for commercial or promotional purposes. Individual mobile phone numbers can be blocked from our services upon request from the owner of the phone, parent or guardian.

5) Licence

Ringtones are covered by licence to the PRS and MCPS, to whom royalties are paid for all ringtones sold within the licences.

6) Disclaimers

There is no intention on the part of top40ringtones.co.uk to "pass off" any realtone, which may have any possible similarity with a known celebrity. Realtones are impressions and they do not carry the approval or the endorsement of the celebrity involved and/or any broadcasting institution. They are "100% unofficial".

There is no association between top40ringtones.co.uk and any companies whose images (logos, picture messages and wallpapers) appear on our web sites.
